Respondents Petition under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned proceedings of the first respondent dated 03.02.1998 in his Reference No.DO:DGM (VR): OO:10:98 and the impugned proceedings of the second respondent dated 11.05.1998 in his Reference No.DO:GM(ALC)38:98, quash the same and consequently direct the respondents to reinstate the petitioner into service of the Indian Overseas Bank as Assistant Manager with continuity of service and all attendant benefits. ORDER

Mr.P.K.Rajagopal, learned counsel appearing for the petitioner submitted that since the petitioner himself is going to argue the matter, he has decided to handover the bundle and hence, sought for adjournment.

2. But this Court is not inclined to entertain any such request. The reason being that when the petitioner had suffered an order of 'removal from service', which was subsequently modified into one of 'compulsory retirement' by the impugned orders dated 3.2.98 and 11.5.98 respectively, namely, 22 years ago for the proven misconduct, this Court is not able to find any merits whatsoever in the writ petition. Accordingly, the writ petition stands dismissed. No costs.
