Respondents Writ petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of certiorarified mandamus to call for the records relating to the impugned order dated 21.2.13 vide Ref. No.38890/R2/2012 issued by the 2nd respondent and quash the same and consequently direct the respondents to place the petitioner in the Junior Assistant in Animal Husbandry Department, Thiruchengode, with all attendant benefits.

ORDER

While the present writ petition has been filed to quash the impugned order and direct placement of the petitioner as Junior Assistant in the Animal Husbandry Department, Tiruchengode, however, during the pendency of the writ petition, M.P. No.2 of 2015 has been filed for amendment of prayer and M.P. No.

1 of 2015 has been filed for impleadment of Principal District Judge, Though learned counsel for the petitioner prayed this Court to allow the above miscellaneous petitions, as the petitioner is seeking continuity of service for which the proposed respondent should be impleaded, however, it is brought to the notice of this Court by the learned Special Government Pleader appearing for the respondents that the petitioner has subsequently been reinstated in service and has also subsequently been promoted and, therefore, nothing survives for adjudication in the present petition. It is further submitted by the learned Special Government Pleader that filing of the miscellaneous petitions is nothing but a tool for the petitioner to protract the proceedings, which this Court should deal with sternly.

Though contentions and counter contentions as above have been raised by both sides, however, this Court, is not inclined dwell deep into the said contentions for the reason that the petitioner has already been reinstated in service and has subsequently been promoted. In such circumstances, it would not be in the interest of either side to have the proceedings protracted any further.

For the reasons aforesaid, this writ petition is closed. Consequent upon the closure of the present writ petition, the miscellaneous petitions are also closed. However, there shall be no order as to costs.
