The petitioner in both the criminal original petitions who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 420 of IPC in Crime Nos.41 and 42 of 2023, seeks anticipatory bail.

2.The case of the prosecution is that one Manikandan had pledged spurious jewellery for a sum of Rs.92,000/- each with the defacto complainants' pawn shops. It is alleged that the petitioner made the defacto complainants' to believe that the said jewelery is a 916 gold however it is a spurious jewellery. Hence, the complaints.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in these cases. Hence, he prays for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) would submit that the petitioner has given the spurious gold to the said Manikandan, who in turn pledged the same in the defacto complainants' shops. He further submitted that the petitioner made the defacto complainants' to believe that the said jewellery is a 916 gold however it is a spurious jewellery. rap 5.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent police and perused the materials available on record.

6.Taking into consideration the facts and circumstances of the case and also considering the fact that the defacto complainants have not recovered the said amount involved in these cases and also considering the gravity of the offence committed by the petitioner, this Court feels that a detailed enquiry is required in this matter. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
