The writ petition is filed with a prayer to consider the representation of the petitioner as per Section 64 of the Wakf Act, 1995.
2. Upon hearing the learned counsel for the petitioner and perusing the material records of the case, it can be seen that the representation of the petitioner is with reference to the Management of Lal Khan Wakf, G.S.No.44, Chidambaram. It is stated that the existing Mutawallis were appointed in the year 2023 and their period is going to expire in the year 2026. The existing Mutawallis are mal-administering the Wakf and it is further stated that from the tenants of the Wakf, they have collected extra amounts as advance, which are not reflected in the Wakf accounts.
3. On perusal of the representation, it is observed that these allegations are generally made. If the petitioner has information, the petitioner has to make specific allegation as to from which tenant how much amount was obtained by the Mutawallis and also the fact that whether it is brought to the account of the Wakf or not. When the Mutawallis are in fag end of their tenure, this kind of enquiries cannot be initiated based on general allegations without any specific allegations or proof in respect thereto. Therefore, keeping open the liberty of the Page Nos.2/5
petitioner to ascertain proper facts and to make a representation with more specific allegations, the present writ petition cannot be countenanced.
4. Accordingly, the writ petition is disposed of with the said liberty to the petitioner. There shall be no order as to costs. 11-02-2026 bsm Page Nos.3/5
