ORDER

This Criminal Miscellaneous Petition has been filed seeking to condone the delay of 101 days in filing the Criminal Revision Case.

2. The learned Government Advocate (Crl. Side) appearing for the respondents would submit that the petitioner had questioned the paternity of his child and, in that regard, a DNA test was conducted. Pursuant thereto, this Court had imposed a cost of Rs.80,000/-.

3. According to the petitioner, the delay was occasioned due to the fact that he was searching for employment. Though this Court does not find the said reason to be wholly satisfactory, taking into consideration the overall factual circumstances, particularly that the issue involved is a matrimonial issue and the respondent is seeking maintenance, and also considering the submission of the learned counsel for the petitioner that he may be permitted to canvass the matter on merits, this Court is of the view that sufficient cause has been shown for condoning the delay.

4. In the result, this Criminal Miscellaneous Petition is allowed, on condition that the petitioner shall pay a sum of Rs.1,00,000/- (Rupees One Lakh only), being a portion of the maintenance, on or before 19.05.2026, failing which this petition shall stand dismissed automatically without any further reference to this Court.
