ORDER
WMP. No.5278 of 2026 is ordered subject to the payment of separate court fee.
2.This writ petition has been filed to direct the respondents to re-classify the property, morefully disclosed in the affidavit filed in support of this writ petition and for issuance of patta in the name of the petitioners, based on their representation dated 17.11.2025.
3.The petitioners claim that they are in possession of the property for a long number of years. The petitioners seek for re-classification of the property as patta land. The petitioners also seek for issuance of patta in their names for the property. The petitioners had given a representation on 17.11.2025 to the respondents seeking for re-classification and for issuance of patta in their names. Since the said representation has not been considered, the petitioners have filed this writ petition.
4.Mr.C.Jayaprakash, learned Government Advocate accepts notice on behalf of the respondents.
5.No prejudice would be caused to the respondents if the petitioners' representation, as stated supra, is considered, on merits and in accordance with law, after giving due consideration to the supporting documents, filed by the petitioners and after hearing the objections of the neighbouring land owners if any and any other third party whom the first respondent deems it fit to enquire, within a time frame to be fixed by this Court. 6.This Court is not expressing any opinion on the merits of the petitioners' representation.
7.For the foregoing reasons, this writ petition is disposed of by directing the first respondent to pass final orders, on merits and in accordance with law on the petitioners' representation dated 17.11.2025 seeking for re-classification of the property, morefully disclosed in the affidavit filed in support of this writ petition as patta land and for issuance of patta in the names of the petitioners for the said property, after giving due consideration to the supporting documents, filed by the petitioner and after hearing the objections of the neighbouring land owners if any and any other third party whom the first respondent deems it fit to enquire, within a period of 12 weeks from the date of receipt of a copy of this order. No costs.
