PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue Writ of Certiorarified Mandamus calling for the records of the 2nd respondent in relation to the panel prepared as on 01.01.2011 in proceedings No.Nil dated 25.05.2011 for the post of B.T.Assistant in English for Avanasi Panchayat Union, Tirupur, and the consequential order of promotion issued in proceedings No.Na.Ka.No.847/A5/2011 dated 16.09.2011 and quash the same in so far as respondents No.4 and 5 are concerned and issue a consequential direction to the respondents No.1 to 3 to include the name of the petitioner in the panel prepared for the post of B.T.Assistant in English as on 01.01.2011 for Avanashi Panchayat Union, Tirupur District at appropriate place and to promote the petitioner as B.T.Assistant in English from the date on which the 4th respondent was promoted as B.T.Assistant in English with service and monetary benefits.

ORDER

This writ petition has been filed to call for the records of the 2nd respondent in relation to the panel prepared as on 01.01.2011 in proceedings No.Nil, dated 25.05.2011, for the post of B.T.Assistant in English for Avanasi Panchayat Union, Tirupur and the consequential order of promotion issued in proceedings No.Na.Ka.No.847/A5/2011 dated 16.09.2011 and quash the same in so far as respondent Nos.4 and 5 are concerned and issue a consequential direction to the respondent 2/4

Nos.1 to 3 to include the name of the petitioner in the panel prepared for the post of B.T.Assistant in English as on 01.01.2011 for Avanashi Panchayat Union, Tirupur District at appropriate place and to promote petitioner as B.T.Assistant in English from the date on which the 4th respondent was promoted as B.T.Assistant in English with service and monetary benefits.

2.When the matter is taken up, the learned counsel for the petitioner submitted that the writ petition has become infructuous. He has also made an endorsement to that effect.

3.In view of the submission of the learned counsel for the petitioner that this writ petition has become infructuous and the endorsement made, this writ petition is dismissed as infructuous.
