ORDER

This writ petition has been filed, challenging the impugned proceedings dated 13.01.2024 and 04.07.2025 issued by the respective respondents.

2. According to the petitioner, as per the impugned proceedings, the respondents are proposing to extend the road by acquiring the petitioner's land. The petitioner claims that their members are all approved plot owners and they have already constructed houses over their respective lands. The petitioner claims that any acquisition of the lands belonging to the members of the petitioner association in the property morefully described in the prayer to this writ petition is arbitrary and illegal.

3. The petitioner had given representations seeking for release of their lands from the proposed land acquisition under Section 30 of the Tamil Nadu Town and Country Planning Act. Since those representations have not been

considered till date, the petitioner has filed this writ petition.

4. Since the representations submitted by the petitioner are old ones, this Court directs the petitioner to submit a fresh representation. The learned counsel for the petitioner, on instructions, would also submit that the petitioner is willing to give a fresh representation. The said statement is recorded.

5. Ms. C. Meera Arumugam, learned Additional Government Pleader accepts notice on behalf of Respondents 1 to 3. Mr. N. Umapathi, learned Standing Counsel accepts notice on behalf of 4th Respondent.

6. This Court is not expressing any opinion on the merits of the petitioner's representations.

7. For the foregoing reasons, this writ petition is disposed of by directing the petitioner to submit a fresh representation to the first respondent, seeking for release of the lands belonging to the members of the petitioner association, morefully described in the prayer to this writ petition, as per the provisions of Section 30 of the Tamil Nadu Town and Country Planning Act, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the

said representation from the petitioner within the stipulated time, the first respondent shall pass final orders on merits and in accordance with law, after giving due consideration to the supporting documents filed by the petitioner, within a period of four months thereafter. No costs. Consequently, connected miscellaneous petitions are closed.
