(R4 suo motu impleaded vide order dated 02.11.2022 made in WP.40106/2005 by SSSRJ, NMJ) Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the respondents 1 and 2 herein to take action against the 3rd respondent for conducting the Diploma in Food Technology Course without obtaining the prior approval from the 1st respondent under All India Council for Technical Education Act, 1987 and prior permission from the 2nd respondent under Indra Gandhi National Open University Act, 1985, by considering the petitioner's representations dated 22.10.2005 and 26.11.2005 respectively. The relief sought in the present writ petition is to direct the respondents 1 and 2 herein to take action against the 3rd respondent for conducting the Diploma in Food Technology Course without obtaining the 2/4

prior approval from the 1st respondent under All India Council for Technical Education Act, 1987 and prior permission from the 2nd respondent under Indra Gandhi National Open University Act, 1985, by considering the petitioner's representations dated 22.10.2005 and 26.11.2005 respectively.

2.The learned counsel appearing on behalf of the 3rd respondent made a submission that the course itself was discontinued by the 3rd respondent from the academic year 2014 onwards. 3.Since the course itself had been discontinued, the relief sought in the present writ petition lost its relevance. Thus the writ petition stands closed. No costs. Consequently, connected miscellaneous petition is closed.
