Sathish Kumar ..Respondent(s) Writ Petition has been filed under Article 226 of the Constitution of India to issue writ of Mandamus, to directing the 1st respondent/Director General of Police, Tamil Nadu, to initiate suitable proceedings and take appropriate action against the 3rd and 4th Respondents/Inspectors of Police, Puthusathiram Police Station and Sendhamangalam Police Station, respectively, under Section 4(1) of the Scheduled Castes and Scheduled Tribe (Prevention of Atrocities) Act, 1989, for wilful neglect of duties, and further directing the 3rd respondent/Inspector of Police, Puthusathiram Police Station, to conduct a proper enquiry on the Petitioner's complaint dated 19.12.2025, forwarded by the 2nd respondent/Superintendent of Police, Namakkal District, vide

proceedings H2/2837/15279/2025, and proceed further strictly in accordance with the provisions of the SC/ST Act and the Rules framed thereunder, including Section 18A(1)(a) and Rule 7.

ORDER

This Writ Petition (Criminal) has been filed seeking a direction to the 1st respondent to initiate suitable proceedings and take appropriate action against the respondents 3 and 4 under Section 4(1) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, for wilful neglect of duties. The petitioner further seeks a direction to the 3rd respondent to conduct a proper inquiry into the petitioner's complaint dated 19.12.2025, which was forwarded by the 2nd respondent vide proceedings H2/2837/15279/2025 and to proceed further in accordance with the provisions of the SC/ST (PoA) Act.

2. The case of the petitioner is that he belongs to the Schedule Caste community. On 18.12.2025, when the petitioner along with his friend were going to his land, they were assaulted and abused by one Venkatachalam belonging to the another caste of Hindu community and he also unlawfully

blocked the Government public road in S.No.217/1 by erecting a wire fence, thereby preventing the petitioner from accessing his property. The petitioner gave a complaint to the Superintendent of Police, Namakkal District, on 19.12.2025, which was subsequently forwarded to the respondents 3 and 4 vide communication No.H2/2837/15279/2025. The petitioner was called for an inquiry by the 4th respondent on 26.12.2025. However, the petitioner contended that despite specific allegations of caste-based abuse, the respondents have not taken any steps till date and hence, the present writ petition has been filed.

The learned Additional Public Prosecutor appearing on behalf of the respondents 1 and 2 submitted that a preliminary inquiry was conducted by the respondent-Police and it was found that there is a property dispute pending between the petitioner and their counter-parties. He would further submit that the inquiry is pending and appropriate action will be taken in accordance with law and the report will be filed within two weeks. He would further submit that the respondents 3 and 4 are shown in their individual capacity and that they are officers attached to Puthusathiram Police Station and a direction may be issued to them in their official capacity.

4. In view of the above submissions made by the learned Additional Public Prosecutor, the Inspector of Police, Puthusathiram Police Station, Namakkal District is directed to complete the inquiry proceedings and take

appropriate action in accordance with law within a period of two weeks from the date of receipt of a copy of this order.
