Perused Records.
2. The revision petition is preferred against the order of acquittal passed by the learned Judicial Magistrate No.1, Virudhachalam in C.C.No.59 of 2009 vide order dated 12.04.2012. Since the revision petitioner, who is the defacto complainant, has a right of appeal under proviso 372 of Cr.P.C., before the Sessions Court at Cuddalore District.
3. Hence, the Registry is directed to return back the records along with the revision petition papers to the District Court, Cuddalore. The Principal District Judge, Cuddalore shall take up the matter and number it as appeal and after issuing notice to the parties, dispose of the case on merits and in accordance with law.
