PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus, directing the respondents to grant of incentive increment for acquiring the qualification of B.Ed by considering the petitioner representation dated 27.08.2019.

O R D E R

This writ petition has been filed for the issue of writ of mandamus, directing the respondents to grant incentive increment to the petitioner for acquiring the qualification of B.Ed. 2.The case of the petitioner is that she was appointed as a Secondary Grade Teacher in the year 1990 and thereafter, she was promoted as a Primary School Head Master in the year 2002. Thereafter, the petitioner got further promotion as Middle School Head Master in the year 2010. In the mean time, the petitioner qualified herself by completing B.Ed degree in the

year 2013. According to the petitioner, the petitioner is entitled for an incentive increment for the completion of the said course in accordance with G.O.Ms.No.107, dated 20.01.1976. The petitioner had made a representation in this regard to the respondents claiming for the said incentive on 27.08.2019. Since the same has not been considered, the present writ petition has been filed before this Court.

3.Heard T.Balachandran, learned counsel for the petitioner and Mrs.V.Annalakshmi, learned Government Advocate appearing for the respondents.

4.Taking into consideration the facts and circumstances of the case and also the limited relief that has been sought for in this writ petition, there shall be a direction to the second and third respondents to consider the representation made by the petitioner on 27.08.2019 and pass appropriate orders in line with the Government Order and the earlier orders passed by this Court, within a period of 8 weeks from the date of receipt of copy of this order. The petitioner is directed to make a fresh representation to the second and third respondents along with a copy of the representation dated 27.08.2019 and a copy of this order.

5.This writ petition is disposed of with the above direction. No costs.
