This writ petition has been filed seeking issuance of a writ of mandamus directing the fourth respondent to issue a fresh patta in the name of the petitioner with respect to the subject property measuring an extent of 15 cents by considering the representation made by the petitioner on 11.03.2024.
2. Heard Mr.M.Venkatesh, learned counsel for petitioner and Mr.M.R.Gokulkrishnan, learned Additional Government Pleader appearing for respondents.
3. The petitioner is claiming right and title over the subject property by virtue of an oral partition that took place in the year 1980 between the petitioner and his brothers and sisters. According to the 2/4
petitioner, 15 cents was allotted to the petitioner and the remaining 41 cents was given to his brothers. After the partition, 41 cents was sold in the name of the petitioner's wife and patta was issued in the name of the petitioner's wife in Patta No.147 for 41 cents. The grievance of the petitioner is that for the 15 cents that was allotted in favour of the petitioner in the oral partition, patta was not issued in spite of application submitted by the petitioner. It is under these circumstances, the present writ petition has been filed before this Court.
4. Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court and considering the limited relief sought for by the petitioner, there shall be a direction to the fourth respondent to deal with the representation made by the petitioner on 11.03.2024 after affording opportunity to the interested parties, if any and a final decision shall be taken on its own merits and in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order.
