2022-07-01Honourable Dr Justice G. Jayachandran2 pages

Crl.R.C.No.329 of 2015 N.ANAND VENKATESH.,J The matter came up for final hearing yesterday and both the sides were heard extensively and orders were reserved. While going through the papers, this Court found that the appellant died during the pendency of this appeal and no orders have been passed permitting Mr.M.Gagan Bothra to prosecute this appeal on behalf of the appellant. In view of the same, the matter was posted under the caption 'For Being Spoken to' today. 2.Mr.M.Gagan Bothra, who appeared in-person submitted that a petition was filed in this regard in Crl.M.P.No.19653 of 2019 and thereafter, the matter was remanded back to the file of the Sessions Court. I went through the entire bundle and this petition is not traceable. Hence, Mr.M.Gagan Bothra is permitted to file a fresh petition seeking for the permission of the Court to prosecute the appeal on behalf of the deceased appellant. 3.Post this case under the same caption on 06.04.2023. 30.03.2023 ssr https://www.mhc.tn.gov.in/judis
