ORDER

This writ petition has been filed for direction to the respondent to consider the representation of the petitioner seeking to carry out correction in his service records with regards to his date of birth as 19.02.1970 instead of 19.02.1964.

Heard, the learned counsel appearing on either side. 3.

The petitioner was appointed as Casual Labourer in Modern Rice Mill by the second respondent on 29.05.2000 and thereafter, his service was regularised on 27.08.2002. His birth certificate was lost and as such, his mother who is being illiterate gave wrong date of birth as 19.02.1964, whereas his original date of birth is 19.02.1970. Therefore, the petitioner submitted representation on 03.11.2023 seeking permission 2/4

to correct his date of birth in service records. 4.

It is seen that the petitioner submitted representation after period of 23 years from the date of joining. As per the Service Rules, the petitioner ought to have submitted representation to change his date of birth within a period of five years from the date of his joining in the service. After period of 23 years, the representation made by the petitioner cannot be considered. As such, this writ petition is devoid of merits and liable to be dismissed.

Accordingly, this writ petition is dismissed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
