Respondent Prayer: Criminal Revision Petition filed under Section 397 r/w 401 of Criminal Procedure Code, to set aside the conviction and sentence made in Criminal Appeal No.38 of 2013, dated 06.03.2015 on the file of the learned Principal District & Sessions Judge, Dharmapuri in confirming the judgment made in S.T.C.No.38 of 2011, dated 18.11.2013 on the file of the learned Judicial Magistrate (F.T.C), Dharmapuri and thus allow the Criminal Revision Case.

ORDER

Today, when the matter came up for hearing, the parties are present before this Court. The learned Counsel on either side filed a joint compromise memo, whereby, the petitioner/accused has now paid to the complainant, by way of Demand Draft No.969884, dated 02.02.2022 for a sum of Rs.7,00,000/- and the balance of Rs.1,00,000/- is lying as deposited to the credit of S.T.C.No.38 of 2011. In that view of the matter, the complainant and the accused have, since, compounding the matter.

2. The joint memo of compromise is taken on record.

3. This Criminal Revision Case is disposed of in terms of the joint memo of compromise, which shall form part of the order in this Criminal Revision and thereby, the judgment of the learned Judicial Magistrate (F.T.C), Dharmapuri, dated 18.11.2013 in S.T.C.No.38 of 2011 and the judgment of the learned Principal District and Sessions Judge, Dharmapuri, dated 06.03.2015 in C.A.No.38 of 2013 are set aside. compounded between the parties. The respondent/complainant will be entitled to withdraw the sum of Rs.1,00,000/- deposited by the petitioner/accused to the credit of S.T.C.No.38 of 2011 on the file of the learned Judicial Magistrate (F.T.C), Dharmapuri along with accrued interest, if any, thereon.
