This petition has been filed to condone the delay of 23 days in filing the appeal.

2.The learned counsel for the petitioner has made an endorsement that the appeal against the second respondent is not pressed.

3. The learned counsel appearing for the first respondent has no serious objection to allow this petition.

4. Being satisfied with the reasons assigned in the affidavit filed along with the petition, we inclined to condone the delay.

5. Accordingly, delay condoned and the petition is allowed.
