The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 35, 35(B) of the Indian Forest Act read with Rule 9 of the Tamil Nadu Timber Transit Rules 1968 in Crime No. 1 of 2021, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found in illegal possession of 82 Red Wood Pieces and its total weight is 2007 kg. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner has been falsely implicated in this case and he is ready and willing to abide by any stringent conditions that may be imposed on him.

4. This is the second anticipatory bail petition. Earlier anticipatory bail petition was dismissed as withdrawn on 07.03.2022. The learned Additional Public Prosecutor would submit that there are totally 5 accused involved in this case. The petitioner is arrayed as A2.

He would further submit that the petitioner was found in illegal possession of 82 Red Wood Pieces and the same was recovered. He would also submit that the petitioner is having some previous cases, similar in nature. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

Considering the nature of offence committed by the petitioner, the petitioner is having some previous cases, similar in nature, the custodial interrogation of the petitioner is very much required in this case and therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the Criminal Original Petition is dismissed. 21.06.2022 Lpp
