PRAYER - This Civil Suit is filed under Order IV Rule 1 of O.S. Rules read with Section 26 and Order VII Rule 1 of C.P.C. seeking to a) Grant a permanent injunction restraining the 2nd Defendant, her men, agents, servants, person or persons claiming under or through her in any way alienating or encumbering the property described in schedule hereto prejudicial to the right and interest of the plaintiff therein till the passing of final decree in terms of the preliminary decree to be passed. b) Grant a permanent injunction restraining the 2nd defendant, her men, agents, servants, person or persons claiming under or through her from interfering with the peaceful possession and enjoyment of the plaintiff in the portion of the schedule mentioned property.
c) Directing division of the property described in schedule hereto into five parts by metes and bounds and to allot to the plaintiff one such part. d) Appoint an advocate commissioner to make a local inspection of the property described in the schedules hereto and to file a report suggesting the mode of division. e) Direct the defendants to pay the cost of the proceedings to the plaintiff. f) Grant to the plaintiff such further or other reliefs as would be decreed appropriate in the circumstances of the case.

Records have been received from the Additional Master - I with the following endorsement dated 30.10.2025:- "Plaintiff's counsel present. Defendant's side no representation at 10.30 AM. Defendant's counsel present at 03.15 PM and endorsed as no oral evidence, DWs closed and also filed memo as the plaintiff's counsel in C.S.71 of 2022 withdrawing the suit as settled out of Court. Post the case before the Hon'ble Court. Submit all the case records before the Hon'ble Court."
2.The learned counsel for the plaintiff has filed a memo seeking permission to withdraw the suit in C.S.No.71 of 2022 as settled out of Court and had also requested for refund of 50% of the Court fee paid to this Court.
3.Recording the submission of the learned counsel for the plaintiff and the memo filed thereof, this Civil Suit is dismissed as settled out of Court. There shall be no order as to costs.
