C.M.P.No.25876 of 2023 in C.M.A.SR.No.112859 of 2022 N.ANAND VENKATESH, J.

This Civil Miscellaneous Petition has been filed seeking to condone the delay of 126 days in filing the appeal against the order dated 31.03.2022 passed in Ar.O.P.No.208 of 2015.

2.Ms.S.R.Sumathy, learned counsel has entered appearance on behalf of the National Highways viz., the 1st respondent. Mr.B.Tamilnidhi, learned Additional Government Pleader takes notice on behalf of the 2nd respondent. The 3rd respondent is the Arbitrator and therefore, no notice is required to be served on the Arbitrator.

3.Heard the learned counsel for the petitioner, learned counsel for 1st respondent and the learned Additional Government Pleader for 2nd respondent and perused the records.

4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 126 days is condoned.

5.The name of the counsel for the 1st respondent and the name of Additional Government Pleader for 2nd respondent shall be printed in the cause list at the time of admission.
