ORDER

This writ petition was filed to restrain the respondents from interfering with the peaceful possession and enjoyment of the property bearing Plot No. 11 and 12 comprised in survey No. 709 / 2 situated at Madambakkam village Rajammal Avenue Tambaram Taluk Chengalpattu District measuring each to an extent of 2400 square feet.

2. The learned counsel for the petitioner would submit that in this case, the petitioner is in enjoyment and possession of the subject property, to the extent of 2400 sq.ft., in Survey No.709/2. Under these circumstances, the respondent is unnecessarily interfering in the peaceful possession of the petitioner without following due process of law.

3. In reply, the learned Special Government Pleader appearing for the respondent had assured before this Court that the respondents will not make any attempt to evict the petitioner from the subject land without following due process of law.

4. Heard the learned counsel for the petitioner as well as the respondent and also perused the entire materials available on record.

5. The submission made by the learned Government Advocate is recorded. The respondents are directed not to evict the petitioner from the subject land without following due process of law.

6. With the above directions, this writ petition is disposed of. No cost.
