(Order of the Court was made by S.S.SUNDAR, J.

1. This Petition is filed to implead the proposed Respondent as the 11th Respondent in the above Writ Petition.

2. Considering the facts that the proposed Respondent has avoided service of notice and that the private notice sent to the proposed Respondent was returned, with an endorsement "not claimed", this Court is of the view that the proposed Respondent is avoiding service of notice and hence, no purpose would be served in ordering fresh notice.

3. Having regard to the averments made in the affidavit filed in support of this WMP and the scope of prayer made in the Writ Petition and the fact that the proposed Respondent is doing commercial activities inside the prime residential area, the proposed Respondent is a necessary party and hence, this WMP is allowed, as prayed for.

4. The Official Respondents are directed to inform the proposed Respondent about the pendency of the litigation by a special notice.

5. Post the main Writ Petition after four weeks. In the meanwhile, issue notice to the newly impleaded Respondent in the Writ Petition.
