Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Certiorarified Mandamus, calling for the records of the Second Respondent in Tender Invitation dated 11.01.2024 in Na. Ka. 1586/2023/A2 and to quash the same, in so far it relates to civil works at 85R Kumarapalayam Panchayat to a tune of Rs. 10 Lakhs and consequently direct the First Respondent to take action against the Second Respondent BDO for the illegality committed.

Heard Mr. J.Srinivasa Mohan, Learned Counsel for the Petitioner, Mr. P.Ganesan, Learned Additional Government Pleader appearing for the First Respondent and Mr. T.Chezian, Learned Counsel appearing for the Second Respondent and perused the materials placed on record, apart from the pleadings of the parties.

The Writ Petition has been filed challenging tender Notification No. Na. Ka. 1586/2023/A2 dated 11.01.2024 issued by the Second Respondent insofar as it relates to civil works to the tune of Rs. 10,00,000/- in 85R Kumarapalayam Panchayat and to consequently direct the First Respondent to take action against the Second Respondent for the illegality committed. 3.

Learned Additional Government Pleader appearing for the First Respondent, on instructions, states that the tender has been cancelled by the 2/4

Second Respondent and further action would be taken against the erring officials and he has made an endorsement to that effect in the court record. In view of the same, nothing remains for further consideration in this Writ Petition, but if the Petitioner still has any grievance to be redressed in the matter, she is not precluded from working out her remedies before the proper forum in the manner recognized by law.

In the result, the Writ Petition is disposed on the aforesaid terms. Consequently, the connected Miscellaneous Petitions are closed. No costs. 11.03.2024 Index: Yes/No NCC: Yes/No Note: Issue order copy by 22.04.2024.
