Petition praying that in the circumstances stated therein the High Court will be pleased to relax the conditions imposed to the petitioner that he shall report before the learned CCB and CBCID Metropolitan Magistrate, Egmore, Chennai daily at 10.30 a.m. till the disposal of the case in Crl.OP.NO.24047 of 2018 by its order dated 31.10.2018.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.C.MOHAN RAJ, Advocate for the petitioner and of MRS.M.PRABHAVATHI ADDL.PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- This Criminal Original petition has been filed to relax the condition imposed on the petitioner to report before the learned CCB and CBCID Metropolitan Magistrate, Egmore, Chennai daily at 10.30am till the disposal of the case, in Crl.OP No.24047 of 2018 by its order dated 31.10.2018.
2. The learned counsel appearing for the petitioner would submit that due to illness, the petitioner was not able to appear before the lower Court. He further submitted that the non-appearance before the lower Court by the petitioner is neither willful nor wanton.
3. According to the learned Additional Public Prosecutor, the petitioner is not complying with the conditions imposed by this Court.
4. Considering the facts and circumstances of the case, the condition already imposed on the petitioner is relaxed and the petitioner shall report before the CCB and CBCID Metropolitan Magistrate, Egmore, Chennai, as and when required for interrogation. -sd/- 13/02/2019 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
