Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified
Mandamus to call for the records pertaining to the tender notification issued by the second respondent in specification No.SE/CD/04/2010-11, quash the same and consequently direct the first respondent corporation and their officials not to alter the conditions of service of the existing workmen involved in dry ash removal work in Unit-II as well as other three units of Mettur Thermal Power Station, till the dispute in I.D.No.51 of 2004 pending on the file of fourth respondent claiming equal pay and the dispute which is pending conciliation before the fifth respondent demanding not to award dry ash removal work to any contractor and to absorb the services of the workman involved in dry ash removal work, is either adjudicated or settled. The prayer in the present Writ Petition has become infructuous, since the date of finalization of the impugned tender notification has lapsed. Hence, the Writ Petition stands closed. It is needless to point out that the petitioner is granted liberty to raise all the grounds raised in the present writ petition before the Conciliation Officer and the concerned Labour Court in connection with their conditions of service. No costs. Consequently, connected miscellaneous petitions are closed.
