ORDER
The petitioner herein is the defacto complainant and he seeks release of the fine amount deposited by the second respondent/1st accused pursuant to the judgment confirming the conviction and sentence imposed on him by the Courts below.
2. The second respondent was sentenced to undergo 1 year of SI, for each of the offence under Sections 506(i) of IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 1998 and directed to pay a fine of Rs.25,000/-.
3. The Appellate Court had ordered that the fine amount paid by the second respondent/A1 shall be paid as compensation to the petitioner herein. It is brought to the notice of the Court that the second respondent has paid the fine amount.
4. The revision is not likely to be taken up in the near future. Hence, this Court is inclined to direct payment of compensation to the petitioner out of the fine amount, upon the petitioner filing an affidavit of undertaking before the learned Metropolitan Magistrate that if the second respondent succeeds in the above revision, he shall refund the same to the second respondent/A1.
