BY [ RESPONDENT ] THE INSPECTOR OF POLICE, CCIW CID COIMBATORE (RURAL), (CRIME NO.1/2000).

Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition that the petitioner should report before the trial court on the first working day of every month at 10.30 AM imposed in Crl.MP.No.12419 of 2016 in Crl.R.C.No.1424 of 2016 dated 01/12/2016,[CRL.MP.2060/2020] Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S. S.KAMADEVAN, Advocate for the petitioner and of MR.K.PRABAKAR ADDL. PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- The petitioner herein filed a petition in Crl.M.P.No.12419 of 2016 praying for suspending the sentence imposed on him by the learned Judicial Magistrate No.IV, Coimbatore in C.C.No.59 of 2001, by judgment dated 15.04.

2015, which has been confirmed by the learned I Additional District and Sessions Judge, Coimbatore by judgment dated 02.08.2016 in Crl.A.No.101 of 2015. This Court, by order dated 01.12.2016, passed an order suspending the sentence imposing certain conditions. Now, the present petition has been filed to relax the condition imposed against the petitioner as regards appearance of the petitioner before the Trial Court.

2.The learned counsel for the petitioner has submitted that the petitioner is regularly complying with the conditions imposed by this Court without fail for more than three years and hence, the condition imposed against the petitioner as regards appearance of the petitioner before the Trial Court, may be relaxed. The learned Additional Public Prosecutor has not seriously opposed the said submission.

3.Taking note of the above and also the facts and circumstances of the case, the condition imposed by this Court in Crl.M.P.No.12419 of 2016 on 01.12.2016 directing the petitioner to appear before the Trial Court on the first working day of every month at 10.30 a.m., is relaxed.

4.This petition is ordered accordingly.
