This application has been filed by the applicant/plaintiff to permit him to mark the additional documents listed in the schedule to the Judges summon in evidence.

2. The learned counsel for the respondents 1 & 2 has strongly opposed to allow this application.

3. However, considering the facts and circumstances of the case, this Court is inclined to permit the applicant/plaintiff to mark the documents as listed in the Judges summon, however, subject to admissibility, relevancy and proof.

Accordingly, this application is allowed.

4. The learned counsel for the plaintiff is directed to take steps for impleading the legal heirs of the deceased 1st defendant.

5. Post the matter on 18.07.2023.
