ORDER

This criminal original petition has been filed seeking a direction to the respondent to register the petitioner's complaint dated 09.03.2016 and to file a final report under Section 173 (2).

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3. On the complaint dated 09.03.2016 given by the petitioner, petition enquiry was conducted in CSR No.41 of 2016 and the same has been perfunctorily closed. On a reading of the closure report, it does not inspire the confidence of this Court.

4.Under such circumstances, the respondent is directed to conduct thorough enquiry afresh in CSR No.41 of 2016 and during the course of enquiry, if any congnizable offence is made out, a regular case shall be registered, following the decision laid down by the Hon'ble Supreme Court in Lalita Kumari v. Government https://hcservices.ecourts.gov.in/hcservices/

of Uttarpradesh & Others reported in (2014) 2 SCC 1, otherwise the petition may be closed under the intimation to the petitioner.

With the above direction, the criminal original petition is closed.
