[Order of the Court was made by M.SUNDAR, J.] Captioned Criminal Miscellaneous Petition has been filed with fix an early date prayer for hearing out the aforementioned Habeas corpus Petition. 2.Mr.V.Parthiban, learned counsel appearing on behalf of counsel on record for petitioner submits that the ground on which the prayer is predicated is that the petitioner who is the spouse of the detenu is suffering from liver cyst and it might exacerbate as Cancer. 3.Learned Additional Public Prosecutor who accepts notice on behalf of the respondents, on instructions submits that it appears to be a case of fatty liver.

cse 4.However, as regards avocation of the detenu we are informed that the detenu is an agriculturist. In this view of the matter, considering the facts and circumstances of the case, we do not find any ground to accede to fix an early date prayer.
5.The sequitur is captioned Criminal Miscellaneous Petition is disposed of as closed albeit preserving the rights of the petitioner to come up with a similar prayer if different circumstances emerge.
