Petition praying that in the circumstances stated therein the High Court will be pleased to condone the absence of the petitioner from April 2020 to February 2021 and to permit the petitioner to comply with the conditions imposed by this Honble court in Crl.MP.No.11994/2018 in Crl.A.No.40/2010 dated 27.09.2018 from March 2021.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.R.VIJAYARAGHAVEN, Advocate for the petitioner and of M/S K.SRINIVASAN, SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- Petition has been filed to condone the absence of the petitioner from April 2020 to February 2021 and to permit the petitioner to comply with the conditions imposed by this Court in Crl.M.P.No.11994 of 2018 in Crl.A.No.546 of 2018 dated 27.09.2018. 2.Learned counsel for the petitioner would submit that the petitioner was granted suspension of sentence by this Court in Crl.M.P.No.11994 of 2018 in Crl.A.No.546 of 2018 dated 27.09.2018 on condition to appear before the Trial Court on the 1st working day of every month at 10.30 a.m.
He would submit that the petitioner is a lady and she resides in Mysore and had been regularly complying with the condition till March 2020 and due to Covid-19, the petitioner was unable to travel from Mysore to appear before the Court from April 2020. He would further submit that failure to appear before the Court to comply with the condition was neither wilful nor wanton but due to pandemic situation, thereby, he would seek to condone the absence of the petitioner in not appearing before the Trial Court during the period between April 2020 to February 2021. He would further submit that the petitioner is also facing difficulty in travelling due to ill health and age related ailments. Accordingly https://hcservices.ecourts.gov.

3.Taking into consideration of the facts and submissions made by the learned counsel for the petitioner, the failure of the petitioner to comply with the conditions is hereby condoned. The petitioner shall continue to comply with the conditions imposed by this Court in Crl.M.P.No.11994 of 2018 in Crl.A.No.546 of 2018 dated 27.09.2018.
