2. When this matter came up for hearing today, the learned counsel appearing for the petitioner would submit that as the petitioner has already filed A.S. No.20 of 2021 before the Appellate Court challenging the ex-parte order in O.S. No.8 of 2011, this Civil Revision petition may be dismissed as withdrawn granting liberty to the petitioner to raise all these issues in the First appeal.
3. In view of the aforesaid submission made by the learned counsel for the petitioner, the petition stands dismissed as withdrawn. It is left open to the petitioner to raise all these issues before the first appellate court. Consequently, connected miscellaneous petition is closed. No Costs.
