ORDER
This Writ Petition has been filed seeking a direction to the respondents No.1 to 5 to provide and ensure adequate police protection to the petitioner for the smooth, peaceful, and unhindered discharge of his duties during the 4-Day Annual Sandal URS Celebration from 03.02.2026 to 06.02.2026 in the interest of public order, safety, and communal harmony.
2.Mr.G.Mohana Krishnan, learned counsel appearing for the petitioner would submit that the petitioner is the Chief Hereditary Trustee and Mutawalli of the Dargah Hazrath Syed Moosa Sha Khaderi (R.A), @ Mount Road Dargah at No.824, Anna Salai, Chennai, as per the directions of the Tamil Nadu Wakf Board. He would submit that elections have not been conducted for the same and as on date the petitioner is continuing and discharging his duties as Chief Hereditary Trustee and Mutawalli. He would further submit that the petitioner is conducting the 4-Day Annual Sandal URS Celebration from 03.02.2026 to 06.02.2026 and the respondents 6 and 7 are unnecessarily interfering with the petitioner conducting the URS.
Therefore, the petitioner sent a representation to the respondents police to give police protection since police protection has not been provided to the petitioner. He would further submit that during the last URS festival, the petitioner had approached this Court in W.P.No.18922 of 2025 and that the Wakf Board submitted their no objection for conducting the URS festival, and hence, the respondents were directed to give police protection.
3.Mr.K.M.D. Muhilan, learned Additional Public Prosecutor appearing for the respondents 1 to 5 would submit that during the last year function, the Wakf Board has expressed their no objection to the petitioner to discharge his duties and that necessary protection has been given to the petitioner by the respondent pursuant to which the 3rd respondent had given police protection. He
would further submit that the respondents are not aware who is now administering the Dargah. However, he would submit that they will ensure that the function is conducted in a smooth and peaceful manner and the police protection will not be given to a particular person or group. He would submit that adequate police strength will be requested to the superior officers and adequate police protection will be provided and they will ensure that the function is conducted without any law and order issues. Recording the undertaking given by the learned Additional Public prosecutor, this Writ Petition is disposed of directing the respondents police to ensure that the event is conducted in a peaceful manner. 04-02-2026 Index: Yes/No Speaking/Non-speaking order MPS To
