This Civil Miscellaneous Petition has been filed to condone the delay of 7 days in filing the C.R.P. SR. No. 125128 of 2018. 2.
Heard the learned counsel appearing for the petitioners and the learned counsel appearing for the respondent. 3.
Learned counsel appearing for the respondent has made a very vehement opposition for condoning the delay of 7 days and he has also submitted that, though two reasons have been given, the reason for not having any means to approach this Court in time cannot be the ground and another reason that on the health ground, no documents have been produced. For both reasons, as has been adduced in the affidavit filed in support of this petition, the said delay of 7 days cannot be condoned. 4.
I have considered the said submissions made by the learned counsel appearing for the respondent. No doubt, the reasons of no means cannot be the plausible reason to accept the delay, but at the same time, when the health reasons are given for 7 days, this Court feels that, no resistance can be shown for such delay.
