ORDER

The petitioner, who was arrested and remanded to judicial custody on 08.02.2026 for the alleged offences under Sections 332(b), 118(2), 109(1), 103(1) of B.N.S. altered to Sections 103(1), 109(1), 118(2), 296(b), 332(a) and

3(5) of B.N.S. in Crime No.55 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on 06.02.2025, the petitioner along with other accused trespassed into the defacto complainant's sister's house and assaulted the defacto complainant's sister and her husband using iron rod, thereby she sustained severe head injury and died on spot.

3. The learned Government Advocate (Criminal side) strongly objected to enlarge the petitioner on bail by stating that there are 4 other previous cases and out of which, one case is a murder case.

4. From the submissions made by the learned Government Advocate, it appears that there are 4 previous cases pending against this petitioner and among which, one case is a murder case. The mere submission of the learned Government Advocate would indicate that every time, the petitioner is misusing the liberty granted by this Court. Therefore, when such person is enlarged on bail, notwithstanding completion of trial, there would be more possibility to involve in the similar nature of offences and therefore, considering the above circumstances, this Court is of the opinion that it is not desirable to enlarge the petitioner on bail at this time.

5. Accordingly, this Criminal Original Petition is dismissed. 06-03-2026 MJS Note:
