O R D E R

The petitioner seeks for a Mandamus to direct the respondent to consider and conduct enquiry on the petitioner's representation dated 07.12.2016 to frame a scheme for the management of the Hazarath Chanda Hussain Aulia Dargah Waqf.

2. The grievance of the petitioner is that the subject matter Wakf is a notified Wakf and registered with the respondent Wakf Board and the Management of the said Wakf, though was taken as early as on 22.10.2013 by the respondent Board, no Scheme is formed so far to appoint the Muthawalli to deal with the Wakf and its property. Therefore, the petitioner made a representation on 07.12.2016 which is said to have been not considered so far.

3. Learned counsel appearing for the respondent Board submitted that the said representation will be considered and appropriate orders will be passed within a period of twelve weeks.

4. Accordingly, this Writ Petition is disposed of without expressing any view on the merits of the claim made by the petitioner and only with a direction to the respondent to consider the representation of the petitioner dated 07.12.2016 and pass orders on the same on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. No costs.
