Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue Writ of Mandamus or any other order or direction in the nature of appropriate writ directing the respondent to update the pension records of the petitioner in PPO No.A870205 pension ID PEN1030561 as per the Aadhar card of the petitioner viz., as Visalakshi Gurusamy and thereby direct the respondent to pay the pension and also arrears of pension from the month of August 2024 to the petitioner. ORDER

This Writ Petition has been filed in the nature of Mandamus seeking a direction against the respondent, viz., the Pension Pay Officer at Nandanam, Chennai, to update the records relating to the pension of the petitioner in PPO No.A870205, Pension ID PEN1030561, in accordance with the name as given in the Aadhar card, namely Visalakshi.

2. The petitioner claims that the pension she was receiving till July 2024 should be paid to her on and from August 2024 onwards. In the affidavit filed in support of the writ petition, it had been stated that the husband of the petitioner Sankaranarayanan was working in the Highways Department in the State of Tamil Nadu. He died in the year 1996. Thereafter, the petitioner has been receiving Family Pension under Pension Payment Order A8701205. It is stated that, in the records, however, her husband had given her name as Malathi. She claims that her actual name is Visalakshi. It is now claimed that if the Aadhaar is to be updated, then, owing to the difference in the names, there will be a 2/5

possibility of the pension which has already been stopped being completely stopped by the respondent. The petitioner had given a representation in this regard on 24.10.2024. Since the same has not been considered, the present Writ Petition has been filed.

Taking into consideration the facts and circumstances of the case, a direction is issued to the respondent to issue a notice to the petitioner, keeping in mind that she is a senior citizen of advanced age, and also permit her to be represented through a representative and examine the documents provided by the petitioner wherein her name is given as Visalakshi and also as Malathi and come to a personal satisfaction whether the names refer to the same person and if it is so, pass an appropriate order updating the pension records. If the respondent is of the opinion that the records have to be updated, then the pension from August 2024 should also be continued to pay to the petitioner herein. The entire process should be completed on or before 14.03.2025. A specific date is given taking into consideration the age of the petitioner.

4. With the above directions, this Writ Petition stands disposed of. No costs.
