..Respondent(s) PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the 1st respondent to consider petitioner representation dated 8.10.2025 and to pay compensation for the land acquired in Survey No.5/3 part to an extent of 18 Sq.Mts. within a time frame to be fixed by this Court.

O R D E R

This Writ Petition has been filed to direct the 1st respondent to pay the compensation to the petitioner for the land acquired in Survey No.5/3 part to an

extent of 18 Sq.Mts. within a time frame to be fixed by this Court. 2.Admittedly, the petitioner has raised a title dispute with the 2nd respondent for the property which is the subject matter of this Writ Petition, which has been acquired by the 1st respondent as per the provisions of the Tamil Nadu Highways Act, 2001. Admittedly, the compensation amount determined by the 1st respondent has also been deposited to the credit of the Civil Court as seen from the written instructions placed on record by the learned Special Government Pleader appearing for the 1st respondent. The determined compensation amount for the acquisition of the subject property has been deposited before the Principal District Court, Chengalpet. As per the provisions of Section 21 (2) of the Tamil Nadu Highways Act, 2001, whenever there is a dispute with regard to apportionment of the determined compensation amount and a reference has been made by the Collector to adjudicate the said dispute to the Civil Court, any party seeking a claim for compensation will have to approach only the said Civil Court.

3.Mr.D.Ravichander, learned Special Government Pleader takes notice on behalf of the 1st respondent. Since no adverse order is passed as against the 2nd respondent, notice to the 2nd respondent is dispensed with by this Court. 4.The learned counsel for the petitioner would now submit on instructions

that the petitioner is willing to approach the Civil Court where the compensation amount has been deposited by the District Collector, seeking for the very same relief that is prayed for in this Writ Petition. 5.Accordingly, this Writ Petition is disposed of by directing the petitioner to approach the Principal District Court, Chengalpet, where the determined compensation amount pertaining to the acquisition of the land morefully disclosed in the affidavit filed in support of the Writ Petition is now lying in deposit by filing appropriate application seeking for payment out and the said Civil Court shall pass final orders on such application on merits and in accordance with law after hearing the objections of the 2nd respondent and any other third party whom the said Civil Court deems it fit to enquire into as expeditiously as possible. No costs.
