Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorari, calling for the records connected with the proceedings issued in Na.Ka.No.F1/Tha.Pa72/2009 dated 25.05.2010 and K1/PR.72/09/U/r3(b) dated 09.07.2010 passed by the second respondent and quash the same.

The writ petition is filed challenging the order of the second respondent dated 09.07.2010 imposing a punishment of reduction to a lower rank in the seniority list in view of the seriousness of the charge. As against the punishment imposed by the second respondent, the petitioner had already filed an appeal on 01.07.2011.

Today, when the matter is taken up for hearing, the learned counsel appearing for the petitioner submits that the petitioner has already filed an appeal before the first respondent and also challenging the order of the second respondent, he preferred this writ petition and he confines the prayer that they will be satisfied if the appeal filed by the petitioner before the first respondent is disposed of on merits. 3.

The learned Additional Government Pleader for the respondents has no serious objection in this regard for a direction to be issued to the first respondent to consider the appeal filed by the petitioner on merits and in accordance with law.

Considering the submissions made by the learned counsels appearing on both sides, this Writ Petition is disposed of, directing the first 2/4

respondent to dispose of the appeal filed by the petitioner on 01.07.2011, challenging the impugned order of punishment issued by the second respondent if the same has not been disposed of till date, within a period of eight (8) weeks from the date of receipt of a copy of this order. If any orders have already been passed, the same shall also be communicated to the petitioner. Consequently, connected Miscellaneous Petitions are closed. 5.

There shall be no order as to costs.
