O R D E R

The prayer in the writ petition is for a Mandamus directing the first respondent to sanction pension and other terminal benefits with arrears payable to the petitioner from 31.01.2015 in accordance with Pension Rules, by considering the representation dated 29.08.2019 and give all consequential benefits within a time stipulated by this Court.

2. According to the petitioner, the respondents have passed the order of recovery for a period of six months for the proven charges as alleged by the respondent Department and the petitioner has also accepted the said punishment order and thereafter, he has made a representation dated 29.08.2019 seeking settlement of terminal benefits by accepting the https://hcservices.ecourts.gov.in/hcservices/

punishment order and since the representation of the petitioner was not considered, he has filed the present writ petition.

3. Heard the learned counsel for the petitioner and learned Additional Government Pleader for the respondents.

4. It is very unfortunate that the respondent has not chosen to take decision on the petitioner's representation inspite of the petitioner having accepting the punishment order. Therefore, this Court directs the first respondent to consider the petitioner's representation dated 29.08.2019 for sanction of pension and other terminal benefits from 31.01.2015 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition stands disposed of. No costs.
