Writ Petition filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the 2nd respondent consider the petitioner complaint dated 27.01.2019 and give police protection to the petitioner and her husband and his family members within a time frame.

ORDER

This petition has been filed to issue a writ of mandamus directing the 2nd respondent consider the petitioner complaint dated 27.01.2019 and give police protection to the petitioner and her husband and his family members within a time frame.

2. The learned counsel for the petitioner would submit that the petitioner, who belongs to Backward Community, loved a person of Schedule caste community and also married him on 18.01.2019 duly registering the same. When this was informed to her parents, they threatened her husband with dire consequences with money and muscle power, pursuant to which the petitioner filed a complaint before the first respondent on 27.01.2019 for giving police protection to them, which was thereafter forwarded to the second respondent for immediate action and protection. https://hcservices.ecourts.gov.in/hcservices/

He further submits that the second respondent thereafter issued CSR.No.13 of 2019, but has not ordered for their protection so far. Hence, the petitioner has filed this petition.

3. The learned Additional Public Prosecutor would submit that the representation submitted by the petitioner is yet to be disposed of.

4. It is seen that the complaint was lodged by the petitioner on 27.01.2019, and on receipt of the same, CSR No.13 of 2019 was also issued by the second respondent. Considering the facts and circumstances of the case, this Court is inclined to consider the writ petition as such the second respondent is directed to consider the complaint dated 27.01.2019 lodged by the petitioner and give adequate police protection to them.

5. With the above direction, this Writ Petition is disposed of. No costs.
