ORDER
Heard the learned counsel on either side and perused the materials available on record.
2. The present petition has been filed seeking extension of time to enable the petitioner to liquidate the property belonging to him and settle the decretal amount payable to the respondents in E.P.No.3166 of 2023.
3. By order dated 12.06.2025, this Court dismissed the challenge to the fair and decretal order dated 20.12.2024 passed in E.P.No.3166 of 2023. However, this Court granted a window of six months to the petitioner to satisfy the decree by voluntarily liquidating his assets so as to avoid the property being brought to sale. The petitioner has not been able to muster the decretal amount within the said period of six months and has now come forward with the present application seeking extension of time, citing ill-health.
4. Considering the fact that the valuable property of the petitioner is at stake, this Court is inclined to grant time till 31.03.2026 for compliance with the conditional order dated 12.06.2025, without fail. It is made clear that the petitioner shall not be entitled to seek any further extension under any circumstances whatsoever. In the event of the decretal amount not being settled
on or before 31.03.2026, it shall be open to the Executing Court to proceed in accordance with Order XXI Rule 64 CPC.
5. Accordingly, this petition is ordered as indicated above. 19-02-2026 Kv To The X Assistant City Civil Court, Chennai.
