ORDER
This writ petition is filed seeking for a direction to the respondents to consider the representation of the petitioner dated 14.09.2023 in accordance with law and direct the respondents to renew the distributorship of M/s. Sri Valli Gas Agency, Valparai in the name of the petitioner. 2.The learned counsel for the petitioner would submit that the petitioner's father obtained LPG gas distributorship license in the name of Sri Valli Gas Agency and one Jayasing who was inimical against the petitioner's father initiated a false case against the petitioner's father and thereby, the petitioner's father's distributorship license was suspended. However, all the false cases against the petitioner's father was dismissed by the concerned Courts.
Thereafter, the petitioner's father passed away and subsequently, the petitioner made an application for renewal of the distributorship license on 14.09.2023. However, by way of letter dated 21.12.2023 it was intimated to the petitioner that the petitioner's father's distributorship agreement itself was cancelled on 02.11.2022. However, no communication was issued to the petitioner to enable the petitioner to challenge the cancellation order and accordingly, he prays for appropriate orders.
3.Per contra, the learned Standing Counsel appearing for the respondents would submit that admittedly for illegality committed by the petitioner's father, the LPG gas distributorship license was suspended and thereafter, the petitioner's father's distributorship agreement was itself cancelled vide order dated 02.11.2022 by the respondents and the same was also intimated to the petitioner. Instead of challenging the cancellation order dated 02.11.2022, filing the present writ petition with the above said prayer is not sustainable and hence, prays for dismissal of the writ petition.
4.Heard the learned counsel for the petitioner and the learned Standing Counsel appearing on behalf of the respondents and perused the materials available on record.
5.Admittedly, the facts of the case is not disputed. The petitioner sought for renewal of LPG gas distributorship license granted to his father vide his representation dated 14.09.2023 and subsequent to which, he was informed vide letter dated 21.12.2023 that the petitioner's father's distributorship agreement itself was terminated on 02.12.2022. Instead of challenging the order dated 02.12.2022, filing the present writ petition with the above said prayer is not sustainable. In view of the above, the writ petition is liable to be dismissed.
6.Accordingly, the writ petition is dismissed, with liberty to the petitioner to participate in future LPG gas dealership auction, in the manner known to law, as and when such advertisement is made by the respondents. No costs. 06-11-2025 Tsg Index:Yes/No Speaking/Non-speaking order Internet:Yes To
