O R D E R
(Order of the Court was made by The Hon'ble Chief Justice) This writ petition is directed against the order under Section 6 of the Tamil Nadu Land Encroachment Act, 1905, whereby it has been alleged that the petitioner is in unauthorised occupation of the property of the Government, as mentioned in the schedule to the order. The petitioner has been called upon to vacate the property within seven (7) days from the date of receipt of the order, failing which the petitioner would be evicted.
2.From the schedule, it appears that the petitioner has raised a concrete parapet wall. Learned counsel appearing on behalf of the petitioner submits that the petitioner will give an undertaking to remove the parapet wall before the District Collector (respondent No.1).
3.This writ petition is disposed of, by recording the aforesaid undertaking of the learned counsel for the petitioner. If the petitioner gives the undertaking to respondent No.1 and also removes the parapet wall, proceedings against the petitioner may be dropped. There shall, however, be no order as to costs.
