Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents 1 to 7 to take appropriate actions on the petitioners representation dated 22.05.2018 and to make suitable correction in the revenue records including survey No, extent and FMB sketch for the Survey No.400/3, 400/4, 400/5 and 400/6 and their extent and grant a patta for his survey number as 400/5 instead of survey number 400/4 with correct measurement of 4466 square feet (26 X 164 feet). ORDER

This writ petition is filed directing the respondents 1 to 7 to take appropriate actions on the petitioners representation dated 22.05.2018 and to make suitable correction in the revenue records including survey No, extent and FMB sketch for the Survey No.400/3, 400/4, 400/5 and 400/6 and their extent and grant a patta for his survey number as 400/5 instead of survey 2/6

number 400/4 with correct measurement of 4466 square feet (26 X 164 feet).

2. By consent of both parties, this writ petition is taken up for final disposal. Since no adverse order is passed against the private respondents, notice to them is dispensed with.

3. Heard both sides and perused the materials placed on record.

4. It is the contention of the petitioner that the petitioner's land is S.No.400/5, however, while granting patta, survey number is wrongly mentioned as S.No.400/4. In fact, S.No.400/4, belongs to the neighbourer. IN this regard, the petitioner has given a representation which is pending without consideration till date. Hence, this writ petition.

5. Considering the limited relief sought for in this writ petition, this Court without going into the merits of the case directs the third respondent to consider the representation of the petitioner dated 22.05.2018 and pass appropriate orders on merits and in accordance with law after giving notice to the neighbouring land owners and any other interested person. Such exercise shall be completed within a period of two months from the date of receipt of a 3/6

copy of this Order.
