This application is filed seeking leave to file a suit for specific performance.

2. The learned counsel appearing for the applicants submits that both the parties are residing within the territorial jurisdiction of the Court. He further submits that the sale agreement entered into between the applicant and the first defendant also within the jurisdiction of the Court. The leave is sought only on the ground that the schedule mentioned property is situated out of the territorial jurisdiction of this Court.

Considering the submissions made by the learned counsel for the applicant and taking note of the fact that the suit is for specific performance and return of money, leave is granted.
