(Crime No.319 of 2024) ...Respondent/Respondent/Complainant PRAYER: This criminal miscellaneous petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, to modify satisfaction Court as Judicial Magistrate Court, Gudiyatham instead of Judicial Magistrate Court, Kilpennathur, Tiruvannamalai in Crl.O.P.No.400 of 2025 order dated 09.01.2025 and also permit the petitioner to comply with the condition in para no. 5(b) the petitioner shall appear before the Gudityatham Town Police Station instead the petitioner shall appear before the Vettavalam Police Station, Tiruvannamalai.

ORDER

The petitioner seeks modification of the condition directing him to execute two sureties to the satisfaction of the Judicial Magistrate Kilpennathur, Tiruvannamalai and to appear before the said respondent police every day at 10.30 a.m. until further orders.

2. The learned counsel for the petitioner would submit that there is another case against the petitioner, in which he has been directed to appear before the learned Judicial Magistrate Gudiyatham and seeks modification on condition 5(b) to appear before the learned Judicial Magistrate, Gudiyatham.

3. Heard the learned Government Advocate (Crl.Side) for the respondent.

4. Accordingly the condition 5(b) imposed on the petitioner in Crl.O.P.No.400 of 2025 to appear before the respondent police is modified, directing him to appear before the learned Judicial Magistrate Gudiyatham on all working days at 10.30 a.m., until further orders.

5. Further, time to furnish surety is extended by a period of two weeks from the date of receipt of a copy of this order.
