PRAYER: Original Petition filed under Section 372 of the Indian Succession Act XXXIX of 1925 read with Order XXV Rule 6 of the Original Side Rules, 1956 praying to grant Succession Certificate to the 1st petitioner herein with power to collect the securities and to receive the interest and dividends on and negotiate and transfer the securities specified in the Schedule hereunder. ORDER
The petitioners seek Succession Certificate in favour of the 1st petitioner in respect of the securities held by one Mrs.Indira Ramanathan, who died intestate on 03.03.2009. The petitioners 1 to 4 submit that they are the daughters of the 1/5
above said deceased. The petitioners further submit that their father and the husband of the deceased Late.Mr.A.Ramanathan predeceased their mother, the deceased herein on 27.09.1984. Therefore the petitioners 1 to 4 are the sole legal heirs of the deceased and are entitled to succeed the securities of the deceased listed under the schedule of the petition in equal proportions.
2. The first petitioner has been examined as PW1. She has produced 5 documents to support her depositions, which are listed as Ex.P1 to Ex.P5 at the foot of the order. The photocopy of the death certificate of the deceased has been marked as Ex.P1. The photocopy of the legal heirship certificate of the deceased has been marked as Ex.P3. The perusal of Ex.P3 clearly substantiates that the petitioners 1 to 4 are the sole legal heirs of the deceased. The general paper publications have been effected which are marked as Ex.P4 and Ex.P5 and no objections have been received for the same.
3. The assertions in the petition have been duly proved by adducing oral evidence supported by documents. In these circumstances, the petitioners are entitled to the relief.
4. In view of the above evidence, the Original Petition is allowed granting 2/5
Succession Certificate in favour of the 1st petitioner, with the power to collect the securities and receive the interest and dividends on and negotiate and transfer the securities mentioned in the schedule to the petition. Index :Yes/No Petitioners' witness:
