Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 2nd respondent to consider the claims of the petitioner and pass orders on the representation dated 25.10.2012 in regard to regularisation of non-employment period from 21.01.2002 to 01.02.2009 and treat the above said period as duty with all benefits.

O R D E R

The relief sought for in this writ petition is for a direction to direct the 2nd respondent to consider the claim of the petitioner and pass orders on the representation dated 25.10.2012 in regard to regularisation of non employment period from 21.01.2002 to 01.02.2009 and treat the above said period as duty with all service benefits.

2. The learned counsel appearing for the writ petitioner made a submission that on account of initiation of disciplinary proceedings, the writ petitioner was terminated from service and subsequently reinstated. However, in the interragnum period i.e., in between the period of termination and reinstatement, the respondent has not paid any service benefits as applicable under the rules. representation on 25.10.2012 to the 2nd respondent and the same is yet to be considered.

3. Thus, without going into the merits of the case, this Court directs the 2nd respondent to consider the representation submitted by the writ petitioner within a period of twelve weeks from the date of receipt of copy of this order and the writ petitioner is directed to enclose a copy of the representation along with the order passed in this writ petition.

4. Accordingly, the writ petition stands disposed of. No costs.
