PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, to direct the 1st respondent police to alter the sections of the above case from Sec.341, 294 (b), 324 and 506(ii) IPC into Sec.341, 294(b), 324, 307, 325, 506(ii) and other relevant provisions of IPC in the above case in Cr.No.138 of 2016 pending on the file of the respondent police.

This petition has been filed to direct the 1st respondent police to alter the sections of the above case from Sections 341, 294(b), 324 and 506(ii) IPC in to Sections 341, 294(b), 324, 307, 325, 506(ii) and other relevant provisions of IPC in Crime No.138 of 2016. 2.The learned Additional Public Prosecutor submitted that the respondents have conducted enquiry in Crime No.138 of 2016 and filed a final report in C.C.No.4014 of 2018 before the X Metropolitan Magistrate, Saidapet, Chennai, and the same is pending for trial.

3.In view of the above, the prayer sought for by the petitioner cannot be considered here now. Accordingly, this Criminal Original petition is dismissed. However, the petitioner is at liberty to file a petition under Section 319 Cr.P.C., before the X Metropolitan Magistrate, Saidapet, Chennai, if any incriminating evidence found as against other parties, if so advised.
